These Terms of Use (“Terms”) govern your use of the TerseEditor macOS application (the “App”) published by Nadzeya Yashchuk, Käferheimerstraße 153b / Tür 12, 5071 Wals-Siezenheim, Austria (the “Publisher”, “we”, “us”, “our”). By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
The short version. TerseEditor is a fast plain-text editor for the Mac. It is currently free beta software, distributed directly from terseeditor.com. Your files stay on your machine. Beta software can have bugs — keep backups of anything important.
The App is licensed, not sold. You are granted a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Apple devices that you own or control. If you later obtain the App through the Apple App Store, the Apple Licensed Application End User License Agreement additionally applies and prevails over these Terms to the extent of any conflict relating to App Store distribution.
The App is provided as a beta: functionality may change, and errors — including errors that could affect files you edit — may occur. You are responsible for maintaining backups of your data. The current beta is not notarised by Apple; macOS will ask you to confirm the first launch.
The App is free of charge during the beta period. If paid tiers are ever introduced, they will be announced in advance on terseeditor.com; nothing will be charged silently.
Files you open and notes you create remain yours. They are processed locally on your device and never transmitted to the Publisher. You are responsible for ensuring you have the legal right to edit the files you open.
You agree not to: (a) reverse-engineer, decompile, or disassemble the App, except to the extent permitted by mandatory law; (b) redistribute the App in modified form or misrepresent its origin; (c) use the App for any unlawful purpose.
To the maximum extent permitted by applicable law, the App is provided “as is” and “as available”, without warranty of any kind, express or implied. The Publisher does not warrant that the App will be uninterrupted, error-free, or compatible with every device. The Publisher's liability for any claim arising out of or relating to the App is excluded to the maximum extent permitted by mandatory law in your jurisdiction. Nothing in these Terms limits any right you may have as a consumer that cannot be waived by contract.
Our handling of personal data is described in the Privacy Policy, which forms part of these Terms.
We may update these Terms from time to time. The current version is always published at terseeditor.com/terms with the effective date shown above.
These Terms are governed by the laws of Austria, without regard to its conflict-of-law rules. The courts of Salzburg, Austria, have non-exclusive jurisdiction, without prejudice to mandatory consumer-protection rules in your country of residence within the European Union.
